The lobby group Citizens Action for Principle and Integrity (CAPI) says its legal challenge to the Government’s $45 billion drawdown from the National Housing Trust (NHT) will now take the form of a constitutional motion.
Co-convenor of CAPI Hugh Fagan says that motion has already been filed in the Supreme Court by attorney-at-law Hugh Wildman.
In its initial attempt to block the draw down, CAPI filed a suit against the Government in the name of Mario Harley.
However, it was later revealed that Harley is not a current contributor to the NHT.
Fagan says CAPI regrets that move, which he adds was only done to allow the attorneys to quickly file the suit.
The Government has already used its majority in both houses of Parliament to pass the necessary amendments to the NHT Act making the planned $11.4 billion annual drawdown over the next four years legal.
