Police Federation takes INDECOM boss to court

The Police Federation has taken the Commissioner of the Independent Commission of Investigations (INDECOM) Terrence Williams to the Supreme Court.
The Federation is seeking declarations that the INDECOM boss does not have the power to arrest and charge the police.
The hearing began today before Justice Horace Marsh, Justice Lennox Campbell and Justice David Fraser.
In February 2011 Police Corporal Malica Reid had brought a claim challenging his arrest and charge by INDECOM investigators.
Reid's claim was struck out because he did not comply with certain directives made by a Supreme Court Judge.
The Police Federation along with Police Officers’ Association, the Special Constables’ Association and the District Constables’ Association took the matter to court seeking a ruling on the issue.
The claimants who are represented by attorneys-at-law Donald Getten and Seymour Stewart are asking the court to interpret the INDECOM Act and rule in favour of their clients.
Attorney-at-law Richard Small is representing INDECOM which is challenging the matter.
INDECOM'S investigators had charged Corporal Reid with the murder of Negril businessman Frederick ‘Mickey’ Hill in Westmoreland.
The Director of Public Prosecutions contended that INDECOM did not have the power to arrest and charge Reid.
The DPP withdrew the charge and preferred a new indictment charging Corporal Reid with Hill's murder.
Reid's murder case is pending in the Home Circuit Court.
