Lawyers to make case against INDECOM

The lawyers representing the eight policemen who had brought a case against the Independent Commission of Investigations (INDECOM), have been given the go ahead to make an application to raise a constitutional point.

When the case was called up in the Supreme Court this morning, the lawyers sought to make an oral application.

However, the court said the lawyers should put their claim in writing and serve it by 12.25 p.m. before the application is heard at 2 p.m.

The eight policemen men were charged last year, after they refused to provide statements to INDECOM regarding the killing of a 16-year-old boy in Spanish Town, St. Catherine.

Their lawyers have argued that INDECOM has no power under the constitution to force the policemen to give statements.

In objecting to the application, attorney Richard Small, who is representing INDECOM, said the claimants’ lawyers had enough time during case management to file the claim.

He insisted that the multiplicity of proceedings have tied up the court’s time and hampered INDECOM in carrying out its duties.
