NewsAl Miller's motion heads to Review Court today2012-05-24 09:07:37 | (0 Comments)
The Judicial Review Court is today expected to begin hearing the motion brought by Reverend Al Miller against Resident Magistrate Georgiana Fraser.
Miller is challenging RM Fraser’s decision to try the case in which he is charged with perverting the course of justice and harbouring a fugitive case. That case is currently before the Corporate Area Resident Magistrate’s Court. Miller was arrested and charged in 2010 after he was found in the company of then fugitive Christopher ‘Dudus’ Coke on the Mandela Highway in St Catherine. It was reported that the pastor was taking Coke to the United States Embassy to surrender to the authorities. Last March, Miller’s attorneys had requested that RM Fraser step aside from trying the case, but she ruled that she would go ahead with the trial. Miller is contending that Fraser should recuse herself because she was the magistrate who signed the arrest warrant for Coke. She also presided at the proceedings at which Coke waived his rights to an extradition hearing. Miller lawyers’ had said they were not accusing the magistrate of bias, but they believed that she should not try the case given her involvement concerning Coke. radio@gleanerjm.com Source: The Gleaner/Power 106 News Send your images, videos and updates to youreport@gleanerjm.com | Click here to Comment Your Comments
