Judge to hand down ruling in Al Miller's case

Senior Puisne Judge Gloria Smith is today expected to hand down her ruling in the motion filed by Reverend Al Miller, who is seeking to have Resident Magistrate Georgiana Fraser removed from trying his case.

Miller’s lawyers have argued that the pastor will not get a fair trial if RM Fraser presides at his trial.

The pastor was arrested and charged in 2010, after he was found in the company of Christopher ‘Dudus’ Coke, who was a fugitive.

His lawyers have pointed out that it was RM Fraser who signed the arrest warrant for Coke.

They say it was also RM Fraser who presided over the committal proceedings at which Coke waived his rights to an extradition hearing.

However, attorneys for RM Fraser have rejected the claim that Miller will not get a fair trial if it is presided over by the magistrate.

They have asked the judge to dismiss the motion.

Miller’s trial for allegedly perverting the course of justice and harbouring a fugitive has been stayed pending the ruling of the Supreme Court.
