Gov’t lawyer says no discrimination in Trafigura case

Queen’s Counsel Raul Henriques who is representing the Attorney General in the Trafigura case, today argued that the People’s National Party (PNP) executive has not shown to the court that there was any political discrimination against them.

The PNP is seeking to challenge a Supreme Court order for several of its members, to answer questions relating to the controversial $31 million donation by Trafigura.

However, in the Constitutional Court today, Henriques said the PNP executive would have to show that after the ex parte order was granted in the Supreme Court in November 2010, there was political discrimination against them.

He said they cannot complain that they were not granted a fair hearing because the court’s rules made provision for them to challenge an ex parte order after it is granted.

In opposing their application, the attorney also noted that members of the PNP did not challenge the order but waited for almost a year, before they filed the claim seeking constitutional redress.
