NewsCCJ dismisses TCL claims2012-11-13 17:43:03 | (0 Comments)
The Caribbean Court of Justice (CCJ) has dismissed a claim by Trinidad Cement Limited (TCL).
TCL was claiming that it had been wronged when the Investigating Panel of the CARICOM Competition Commission conducted an investigation into alleged anti-competitive business by the company. The Trinidad-based cement company had argued that there had been no proper request for the investigation and that the commission had failed to respect its rights as an interested party as required by sections of the Revised Treaty of Chaguaramas. However, in its ruling, the five-member CCJ disagreed, pointing out that during the preliminary assessment phase, the commission only carried out discussions around whether a potential investigation is within its jurisdiction and is justified under the circumstances.
