Mayor Barnswell says he is surprised by the ruling from the Director of Public Prosecutions that he be charged for misleading the Office of the Contractor General in the investigation of the Spaldings Market affair.
Barnswell says he is now awaiting final instructions from his attorney, Seymour Stewart.
"I have founded the findings of the DPP surprising and that's why I now await my attorney's interpretation of both findings and from there we will be able to be in a better position to make a proper response," said Barnswell.
In her ruling, the DPP Paula Llewellyn said she’s of the view that failure to initiate prosecution will have a profound effect on public morale, given that the elements of the offence have been made out.
Barnswell says the Council is yet to receive formal notification from Jamaica Labour Party councillors that a motion of no confidence will be brought at the next general council meeting.
The Clarendon Parish Council will have its next general meeting on October 5.
Barnswell has dismissed calls for his resignation.
