17. The OCG concludes that in relation to the 53 contracts which are represented in Appendix 2 of

this Report, the St. Ann Municipal Corporation had full knowledge that the complete scope of

works would not have been executed by the contract awardee, but nonetheless prepared contract

documents which gave the impression that the contract awardee would have completed same. In

all such instances, the OCG concludes that the actions of the Corporation amount to a fraudulent

misrepresentation.

18. The recommendation, implementation and execution of a number of the contracts outlined in this

report bear the likeness of the offence of a conspiracy to defraud the Government of Jamaica

involving (a) the Office of the Member of Parliament, (b) the St. Ann Municipal Corporation and

(c) the named contractors. This web of deceit is evidently seen in the representations which have

been made by several contractors, who, having signed contracts certifying that the works as

represented “…

is the correct account for all work done … for the Parish Council of St. Ann for

payment due

”, subsequently admitted that the complete scope of works were not completed by

them and that the contract was signed with this knowledge. The OCG is of the considered opinion

that all 53 contracts as outlined in Appendix 2 of this report should be the subject of further

criminal investigation.

19. The OCG accepts the testimonies of Mr. Blyden Brown, Ms. Sandra Garrick and Ms. Donnette

Hamilton that ‘blank contracts’ were presented to them by officers of the St. Ann Municipal

Corporation.

20. The OCG accepts the testimonies of Mr. Blyden Brown, Ms. Donnette Hamilton, Mrs. Joan

McDonald, Mrs. Ivy Clarke Robinson, and Mr. Reginald Christie, that upon the encashment of the

cheques in respect of the contracts which were awarded to them, the monies were taken back to

the Office of the Member of Parliament, South East, St. Ann, and handed over to the custody of

Ms. Andrea Smith and/ or Mr. Ezekiel Russell.
