13. Based upon the statutory and common law provisions concerning obstruction and the perversion

of the course of justice, the OCG recommends that criminal investigations be pursued and a

determination be made as it regards whether the actions of Mr. Richard Lake amounts to

interference and/or gives rise to an obstruction.

Mr. Richard Lake persuaded Mrs. Joan McDonald to make a false statement and to mislead the

contractor General by making the false statement.

14. The OCG recommends that further criminal investigations be pursued as it regards all 53 contracts

as outlined in Appendix 2 of this report, given the findings which bear likeness to a conspiracy to

defraud the Government of Jamaica involving (a) the Office of the Member of Parliament, (b) the

St. Ann Municipal Corporation and (c) the named contractors.

15. The OCG recommends that criminal investigations be initiated into the involvement and

culpability of Ms. Andrea Smith in,

inter alia

, (a) creating a false document (b) aiding and

abetting Mrs. Joan McDonald to utter the said false document and (c) the numerous allegations of

monies given to her by contractors/facilitators in respect of contracts awarded by the St. Ann

Municipal Corporation.

16. The OCG recommends that criminal investigations be initiated into the involvement and

culpability of Mr. Ezekiel Russell and all councillors within the St. Ann Municipal Corporation, as

it regards,

inter alia

, allegations of the receipt of monies from contractors/facilitators in respect of

contracts awarded by the St. Ann Municipal Corporation.
