REFERRALS
The OCG, in the conduct of its Investigation, is required to be guided by Section 21 of the Contractor
General Act.
Section 21 of the Contractor General Act provides as follows:
“
If a Contractor-General finds, during the course of his
Investigations or on the conclusion thereof that there is
evidence of a breach of duty or misconduct or criminal
offence on the part of an officer or member of a public
body, he shall refer the matter to the person or persons
competent to take such disciplinary or other proceeding as
may be appropriate against that officer or member and in
all such cases shall lay a special report before
Parliament.
”

Based upon the evidence presented by representatives of the St. Ann Municipal Corporation, the OCG is
hereby referring a copy of its Special Report of Investigation to the Office of the Director of Public
Prosecutions (ODPP), for due consideration and/or investigation as may be deemed fit, having regard to
the breaches of the Government of Jamaica Handbook of Public Sector Procurement Procedures and the
attendant Regulations, which have been identified herein.
Further, the OCG is hereby referring the matter to the Office of the Director of Public Prosecutions for a
determination to be made in relation to the following matters:
1.
Whether the actions of the Accounting and Accountable Officers of the St. Ann Municipal
Corporation, in authorizing and disbursing payments to Mr. Blyden Brown in the amount of
$285,000.00, without the requisite verification of the satisfactory completion of work in
performance of a contract which was awarded by the Corporation, was in breach of the FAA Act.
