Having regard to the foregoing, the question of law which must be posed is whether, there is,
prima facie
evidence of obstruction, on the part of Mr. Richard Lake, contrary to Section 29 of the Contractor General
Act.
Section 29 of the Contractor General Act provides that:
“
Every person who—
(a)
willfully makes any false statement to mislead or
misleads or attempts to mislead a Contractor-
General or any other person in the execution of his
functions under this Act; or
(b)
without lawful justification or excuse –
(i)
obstructs, hinders or resists a Contractor-
General or any other person in the execution
of his functions under this Act;
or
(ii)
fails to comply with any lawful requirement of
a Contractor-General or any other person
under this Act; or
(c)
deals with documents, information or things
mentioned in section 24 (1) in a manner inconsistent
with his duty under that subsection,
shall be guilty of an offence and shall be liable on
summary conviction before a Resident Magistrate to a fine
not exceeding five thousand dollars or to imprisonment for
