a. The contractor shall exercise reasonable skill, care and
diligence in the performance of the works described below:
Description of works:
a)
White washing of wall from Sections of Green Park
to Top Higgin Town
b)
Carting away debris resulting from (a) above from
the roadway and verges to an approved NSWMA
disposal site.
b. The contractor shall also:
a)
Liaise with NSWMA’s representatives and keep the
representatives informed about the contractor’s
progress;
b)
Supervise the execution of the works by persons
employed by or under the control of the contractor;
c)
Prepare site reports and minutes regarding the
execution of the works and provide appropriate
status reports to the NSWMA as required;
d)
Provide all the resources, including but not limited to
personnel, required to perform the works.
Clause 1.3 – SUB-CONTRACTING:
The Contractor shall not transfer or assign this contract or
subcontract any of the work herein

It was further noted that the amount of $350,000.00 was made payable to Owen Grant seven (7) days after
the works have been completed. The contract further noted,
